New TILA - RESPA Rules: The Requirements, Pitfalls to Avoid & Best Practices

TILA - Regulation Z has been modified to mandate early disclosures effective July 30, 2009 on all types of mortgage loans. TILA - Regulation Z has also been modified to create a new class of higher priced mortgage loans with new requirements. These rules become effective October 1, 2009.

TILA - Regulation Z has also outlawed certain advertising, marketing, lending and servicing practices on all mortgage loans.

RESPA - Regulation Z has been modified to create a new definition of what is an application. The GFE and HUD-1 forms have been standardized and completely revamped. There is also a zero tolerance for certain errors. These rules become effective January 1, 2010.

The new changes are extremely significant. It affects nearly every single financial institution and mortgage lender.
